We had a discussion some time ago about how much power an employer
should have over the liberty of employees away from work. I say still
that except in extraordinary circumstances, "You hire me to do these
tasks for these hours, the rest of my life is my own".
This is an old story, but the Budweiser version below is new.

Budweiser distributor says its worker who drank Coors was fired for
other reasons
GREELEY, Colo. (AP) - A man who says a Budweiser distributor fired him
for drinking a Coors beer made disparaging remarks about the company
while drunk and in uniform at a bar, a company attorney said.
Jeff Bedingfield, who represents American Eagle Distributing Co.,
disputed claims made by fired worker Ross Hopkins, 41, in a lawsuit
heading for trial in state court.
"The question of how much Mr. Hopkins can remember the night of the
incident is in question," Bedingfield said in a report published by the
Greeley Tribune on Wednesday.
Hopkins sued last year claiming he was fired in May 2003 after a
relative of American Eagle's majority shareholder spotted him drinking
a Coors at a Greeley bar. Hopkins, a warehouse worker who had no
contact with the public, said he was off duty and not wearing his
uniform.
Bedingfield said witnesses in the bar recall events differently than
Hopkins does.
He also said Hopkins had been demoted from warehouse manager two weeks
before he was fired.
Hopkins said American Eagle has refused to tell him what disparaging
remarks he allegedly made. He also said he's looking forward to the
court battle "because what they did was terribly wrong. They know it, I
know it, but they're not willing to admit it."
Colorado law says workers cannot be fired for a legal activity while
off duty and away from work. There are exceptions, such as when a
worker's actions relate to an occupational requirement or create a
conflict of interest. American Eagle said in a court filing that it was
necessary to fire Hopkins to avoid a conflict of interest.
A trial date has not been set. |

At one time California anti-discrimination laws applied to companies
with 20+ employees. At the time I worked for a 19-person company
and management adamantly refused to hire number 20. Why? So they
could discriminate. I looked around. 10 women, 9 men. Someone
born on every continent but Antarctica. One of the more diverse
groups I've seen for its size. I asked what the discrimination was.
I was told that if the management caught me smoking, even after
hours, I was fired and that's what the discrimination was. I
laughed and laughed. |
